Mediation v Courts

Courts

Mediation differs dramatically from adjudication in the courts and arbitration. In those processes a judge or arbitrator hears the evidence relating to a particular conflict and the determines who "wins" or who "loses" based upon the applicable law. In mediation, the parties, (YOU) control the outcome, and the potential exists for for an agreed-upon solution which preserves the essential interest of all the disputants (sometimes called a "win-win" result). 

While courts and arbitrators are often limited to specific remedies, the outcome of mediation is limited only by the nature of the problem and the extent of the parties' own creativity.

Many courts use mediation as a form of dispute resolution as they have a backlog of cases and have found it to be an effective means to settle many types of cases. The Ohio Supreme Court has taken a lead role in mediation in the past several years and has created their own dispute resolution section that provides guidance for mediation to the courts of Ohio as well as mediators.

Cost

Another important attribute of mediation is the costs associated with mediation versus litigation. Litigation can be very time consuming and costly. Whereas in the proper mediation setting disputes can be resolved in a timely fashion at much less of a costs to the parties. As a caveat, this is not to suggest that mediation is a replacement for all litigation. Many times the mediation agreement is filed with a court by means of using your attorney to file all the proper pleadings and documents. In mediation the parties are recommended to contact their attorney should they have legal questions or feel the need for their decisions to be reviewed.

Privacy

Many people value their privacy and therefore use mediation to maintain privacy. Most court records are public documents and therefore can be accessed by the public including the media. Mediation can take place in a private setting between the parties and thus much more privacy is maintained.
